Forkin is prepared for users in the EEA, United Kingdom, Switzerland, United States, Canada, Australia, New Zealand, Brazil, Mexico, Japan, South Korea, Singapore, Hong Kong, Taiwan, Israel, Chile, Colombia, Argentina, Peru, and South Africa. For Quebec users, the complete French version of this policy and the Terms must be available through the same digital flow before paid launch in Quebec.

Effective 18 June 2026, Forkin keeps account-linked AI-scan photos, meal-scan photos, price-tag photos, receipt photos, extracted receipt line items, and related scan metadata while your account is active. We use this data to operate Forkin, improve our own recognition, matching, price extraction, anti-fraud, and portion-estimation systems, and maintain account safety.

We do not sell this data, use it for targeted advertising, or provide it to third parties to train their general-purpose AI models. You can opt out of photo-based recognition improvement in the app under Settings - Privacy & Data - Help improve recognition. Account deletion deletes account-linked scan, meal, receipt, and body-progress upload files from Forkin storage, subject only to narrow legal/security logs described in this policy.

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Sensitive Information. When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information:

Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument. All payment data is handled and stored by Stripe, Apple (App Store) and Google (Play Store). Social Media Login Data. We may provide you with the option to register with us using your existing social media account details, like your Facebook, X, or other social media account. If you choose to register in this way, we will collect certain profile information about you from the social media provider, as described in the section called "HOW DO WE HANDLE YOUR SOCIAL LOGINS?" below.

Application Data. If you use our application(s), we also may collect the following information if you choose to provide us with access or permission:
  • Geolocation Information. We may request access or permission to track location-based information from your mobile device, either continuously or while you are using our mobile application(s), to provide certain location-based services. If you wish to change our access or permissions, you may do so in your device's settings.
  • Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device's camera, microphone, storage, photos / photo library / storage, push notifications, location services / gps, motion sensors / sensor data, health (healthkit), and other features. If you wish to change our access or permissions, you may do so in your device's settings.
  • Mobile Device Data. We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server). If you are using our application(s), we may also collect information about the phone network associated with your mobile device, your mobile device’s operating system or platform, the type of mobile device you use, your mobile device’s unique device ID, and information about the features of our application(s) you accessed.
  • Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device's settings.
This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

The information we collect includes:
  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). 2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

6. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?

In Short: We offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies.

As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. The terms in this Privacy Notice govern your use of the AI Products within our Services.

Use of AI Technologies

We provide the AI Products through third-party service providers ("AI Service Providers"), including Scaleway. As outlined in this Privacy Notice, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products for purposes outlined in "WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR PERSONAL INFORMATION?" You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.

Our AI Products are designed for the following functions:

  • Nutrition analysis

How We Process Your Data Using AI

All personal information processed using our AI Products is handled in line with our Privacy Notice and our agreement with third parties. This ensures high security and safeguards your personal information throughout the process, giving you peace of mind about your data's safety.

How to Opt Out

We believe in giving you the power to decide how your data is used. To opt out, you can:
  • Log in to your account settings and update your user account

  • Email privacy@forkin.io to request that your data be excluded from AI-based processing and personalization.

7. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and log in using your third-party social media account details (like your Facebook or X logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a social media platform.

We will use the information we receive only for the purposes that are described in this Privacy Notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.

8. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in Germany, Netherlands, Slovenia, Finland, United States, France, Poland, Ireland and Iceland. Regardless of your location, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" above), including facilities in Germany, Netherlands, Slovenia, Finland, United States, France, Poland, Ireland, Iceland, and other countries.

If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law.

European Commission's Standard Contractual Clauses:

We have implemented measures to protect your personal information, including by using the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.

9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

10. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. 11. DO WE COLLECT INFORMATION FROM MINORS?

12. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on your state of residence in the US or in some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. If a decision that produces legal or similarly significant effects is made solely by automated means, we will inform you, explain the main factors, and offer a simple way to request human review. You will then be removed from the marketing lists. Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Submit a deletion request via the in-app settings under Account → Delete Account, or by emailing privacy@forkin.io.
Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

Global Privacy Control: We recognize and honor Global Privacy Control (GPC) signals. If you use a browser or extension that supports GPC, we will treat this as a valid request to opt out of the sale or sharing of your personal information for targeted advertising purposes under applicable state privacy laws, including the California Consumer Privacy Act (CCPA). When we detect a GPC signal from your browser, we will automatically apply your opt-out preference without requiring you to take any additional action. Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.

Appeals

Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at privacy@forkin.io. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. 17. BODY PROGRESS PHOTOS — SENSITIVE DATA, ENCRYPTED AT REST

If you use the body-progress feature, you may store progress photos. We treat these as special-category (health) data under Article 9 GDPR and store them only after your separate explicit consent (Art. 9(2)(a)); you can withdraw it any time in Settings → Body Progress and delete individual photos immediately. Each photo is encrypted with AES-256-GCM on our server before storage; the per-photo key is wrapped by a master key managed by Scaleway Key Manager (Paris/Warsaw). Even in a storage breach, the raw bytes cannot be decrypted without both the per-photo key (in our database) and the Scaleway-managed master key. We do not use end-to-end encryption — a deliberate choice that lets us render a coach view you explicitly invite and honour erasure by cryptographic shredding. Body photos are private by default; we never use them for advertising, never share them with third parties for their own purposes, and never use them to train AI models.

18. HEALTH PLATFORM SYNC (OPTIONAL)

If you enable health sync, Forkin can exchange data with Apple HealthKit (iOS) or Google Health Connect (Android): we write the nutrition you log and read/write your body weight, and (if you opt in) read active-energy data to refine your calorie estimate. This happens on your device, under Apple's or Google's own health-data terms and the OS permission you grant. We treat any health values stored in your Forkin account as Article 9 data under the explicit-consent and retention rules above. You can revoke the permission anytime in your device settings.

19. AI SCANS, MEAL SCANS, RECEIPTS, AND RECOGNITION IMPROVEMENT

AI-scan photos, meal-scan photos, price-tag photos, and receipt photos you upload to Forkin are stored on our servers linked to your account for as long as your account is active. Purposes. We use these photos and any data extracted from them (such as extracted receipt line items and related scan metadata) for the following purposes: (1) delivering the scanning, meal-log, receipt-parsing, and nutrition features you request; (2) improving Forkin's own product- and food-recognition, matching, price-extraction, portion-estimation, and anti-fraud systems; and (3) maintaining service safety and quality. We also compute and store visual embeddings (numerical feature vectors) derived from these photos for the same purposes. Legal basis. Feature delivery and service operation are necessary for the performance of our contract with you (Article 6(1)(b) GDPR) or are based on our legitimate interests in operating a reliable service (Article 6(1)(f) GDPR). Using your photos to improve Forkin's own recognition systems is based on our legitimate interests in providing accurate scanning results (Article 6(1)(f) GDPR), balanced against your right to object. Where photos relate to health or dietary matters that constitute special-category data under Article 9 GDPR, we rely on your explicit consent (Article 9(2)(a) GDPR). Opt-out of recognition improvement. You can object to your photos being used to improve Forkin's recognition models at any time in Settings → Privacy & Data → Help improve recognition. Opting out does not affect the scanning features themselves or any contributor rewards you may receive. No sale, no targeted advertising, no third-party AI training. We do not sell your photos or data extracted from them. We do not use them for targeted advertising. We do not provide them to third parties to train their general-purpose AI models. Body-progress photos and special-category data. Body-progress photos and any other special-category data under Article 9 GDPR are never used to train or improve any recognition or machine-learning model. They are kept encrypted and entirely outside our recognition and training pipelines. Public catalogue contributions. Approved product photos or other content you contribute to the shared Forkin catalogue may be anonymised rather than deleted when you close your account, to preserve the integrity of the public catalogue record. Deletion and export. When you delete your account, account-linked AI-scan, meal-scan, price-tag, and receipt photos and their associated metadata are deleted from Forkin's active storage, subject only to limited retention for legal-obligation, security-log, and backup purposes described in the retention-periods section below. Data exports include the personal upload metadata associated with your account. On devices with LiDAR sensors, the meal scanner also captures a short depth/spatial scan of your meal — a depth map and camera measurements. This is environmental-scan data of the plate and its immediate surroundings; it is not biometric data and is not used to identify you. We retain it to improve our portion-estimation models. Our legal basis is our legitimate interest (Article 6(1)(f) GDPR), and you can switch it off at any time in Settings → Privacy → Photo improvement (the same control that governs photo-based model improvement). It is processed in the EEA/EU and excluded from advertising, sale, and third-party general-purpose AI training, and is erased when you delete your account.

20. HOW LONG WE KEEP YOUR DATA (RETENTION PERIODS)

We keep personal data only as long as necessary for the purposes described in this policy, and apply the following retention periods: - Account data (email, profile): while your account is active; erased within 30 days of a deletion request. - Inactive accounts: accounts remain until deleted by the user; we may contact long-inactive accounts before any future cleanup. - Scan history, pantry, recipes: while your account is active; deleted on account closure. - Dietary preferences, diet goal, body metrics (special-category data): until you withdraw consent (erased within 7 days) or delete your account. - Body-progress photos: until you delete the photo or your account. - AI-scan photos, meal-scan photos, price-tag photos, and receipt photos: retained while your account is active and linked to your account; deleted when you close your account (subject to backup and legal-log exceptions described below). - Extracted receipt line items and scan metadata: retained while your account is active; deleted on account closure. - Price-tag proof photos: retained for as long as the price record they evidence is live, as anti-fraud and dispute evidence (legitimate interest, Art. 6(1)(f)); deleted with the price record. - Product photos you contribute to the catalogue: retained as part of the product database; permanently unlinked from your account (anonymised) if you delete your account — see the Terms, "Content you create". - Crash reports (Sentry): 90 days. - Product analytics (PostHog): 13 months. We also analyse usage data we already hold — such as how often features are used and where people get stuck — in aggregate, to understand and improve the service. Our legal basis for this internal analysis is our legitimate interest (Article 6(1)(f) GDPR); the results are aggregate statistics that do not identify you, and we never sell this data or use it for advertising. You can object at any time in Settings → Privacy & Data → Usage analytics, which also turns off product analytics. - Subscription & payment (accounting) records: 5 years from the end of the financial year (Polish Accounting Act Art. 74 + Tax Ordinance Art. 70) — legal-obligation retention that overrides erasure requests. - DSA notices & Statements of Reasons: 5 years. - Server access logs: 90 days, then anonymised (last IP octet zeroed). - Consent audit log: while account is active + 3 years (Art. 7(1)). - Database backups: 90 days.

21. DIETARY, ALLERGEN AND DIET-GOAL DATA AS SPECIAL-CATEGORY DATA (ARTICLE 9 GDPR)

If you set dietary preferences (e.g. vegan, vegetarian, halal, kosher), allergen flags, or a diet goal, we treat this as special-category data under Article 9 GDPR (it may reveal philosophical or religious beliefs or a health condition — CJEU Case C-184/20). Our legal basis is your explicit consent under Article 9(2)(a) GDPR, recorded separately and withdrawable at any time in Settings; on withdrawal we erase the related fields within 7 days. We never share it with advertising networks or data brokers and never use it to train external AI models.

22. VOICE AND AUDIO DATA — CCPA/CPRA CATEGORY H DISCLOSURE

When you use voice features (such as recipe-from-audio, voice meal logging, or voice commands), Forkin processes your voice recording solely to fulfil the feature you requested (one-shot transcription). The audio recording is processed in real time and is not retained beyond what is strictly necessary to complete the requested action. Forkin does not sell your audio data, does not share it with third parties for cross-context behavioural advertising, and does not use it for advertising purposes of any kind. This disclosure applies to CCPA/CPRA Category H (audio, electronic, sensory, or similar information). 23. CONSUMER HEALTH DATA — US RESIDENTS (WASHINGTON MY HEALTH MY DATA ACT AND NEVADA SB370)

For residents of the United States, certain information we process — including your dietary preferences and allergens, diet goal, body metrics and measurements, food-diary nutrition data, and any data you connect from Apple Health or Google Health Connect — is 'consumer health data' under laws such as Washington's My Health My Data Act and Nevada SB370. We collect it only with your opt-in consent, use it only to provide the features you request, and we do not sell it or share it for advertising. You may access, withdraw consent for, and delete this data. See our standalone Consumer Health Data Privacy Policy at https://forkin.io/consumer-health-data. We record approximate or precise device location only to show nearby stores and prices; we do not use location to identify, infer or record any attempt to acquire or receive health services or supplies, and we do not treat or derive it as consumer health data. We do not use geofencing around any health-care facility.

24. CANADA — TRANSBORDER DATA FLOWS (PIPEDA)

If you are located in Canada, your personal information is processed and stored by us and our service providers in the European Union. While outside Canada, it may be subject to access by foreign courts, law-enforcement, or regulatory authorities under the laws of those jurisdictions. You may request: confirmation that we process your data; access; correction; anonymization, blocking, or deletion of unnecessary or excessive data; portability; information about entities with whom we share data; and you may withdraw consent. Our processing relies on legal bases under the LGPD. Forkin publishes Eutopix Labs P.S.A. Privacy Office as its public LGPD Encarregado (data protection officer) channel at privacy@forkin.io. Forkin keeps a separately recorded internal owner and backup for data-subject and ANPD communications. Mexico (Federal Law / ARCO). This Privacy Policy serves as our full privacy notice (aviso de privacidad). You may exercise your ARCO rights — Access, Rectification, Cancellation, and Opposition — and limit the use or disclosure of your data. Japan (APPI).
